Oliver’s Labels Terms & Conditions:
Fundraising Program

1.
Oliver’s Labels reserves the right to cancel the Fundraising Program (henceforth also referred to as “Program”) or to change or amend these Terms and Conditions at any time without notice.
2.
By participating in the Fundraising Program, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to participate in the Fundraising Program in any manner.
3.
You may not participate in the Fundraising Program where doing so would be prohibited by any applicable law, rule, or regulations.
4.
Oliver’s Labels reserves the right to suspend or terminate a Fundraising Program account (henceforth referred to as “Account”) without notice if the Account or its administrator does not comply with any of these Terms and Conditions or at Oliver’s Labels discretion.
5.
Oliver’s Labels reserves the right to remove referred sales that are believed to be made in violation of these Terms and Conditions.
6.
Employees of Oliver’s Labels and their immediate family members and household members may not participate in the Fundraising Program.

The Program

7.
There is no cost to register, join or maintain an Account.
8.
There is no purchase necessary to have an Account.
9.
Fundraisers are intended for organizations to raise money and not for individuals. Individuals may participate in the Label League Referral Program.
10.
An Account must be administered by an individual (henceforth referred to as “Administrator”) in the aforementioned organization.
11.
An Administrator has access to a login area. Pages in the login area include Commissions, Marketing Materials, Program information, access to Fundraiser social media pages, and these Terms and Conditions.
12.
The format of the Fundraiser’s custom referral link (henceforth known as “Referral Link”) is “www.oliverslabels.com/” plus a custom suffix requested by an Administrator. For example, “www.oliverslabels.com/happydaycare”. The custom suffix may be rejected if the suffix is already being used or at Oliver’s Labels discretion, at which point another suffix may be requested.
13.
An Account receives credit for a sale when:
13.1.
The customer uses the Account’s Referral Link when making a purchase.
13.2.
The customer provides Oliver’s Labels with the name of the fundraising organization (henceforth referred to as “Organization”) when making a purchase (online or by phone).
14.
When a Referral Link is used, a cookie is stored in the web browser associating the user with the Account. If the user returns to the Oliver’s Labels website up to a year later, the Account will continue to be associated with the user.
15.
An Account receives 20% commission (unless otherwise stated) on a referred order’s subtotal, excluding gift cards, shipping and taxes and after coupons or discounts have been applied.
16.
An Account has no performance expectations, quotas or requirements associated with sales in order to maintain the account.
17.
An Account’s balance never expires.

Sales

18.
Commission for a sale appears on the Commissions page once the order status has been set to “shipped” by Oliver’s Labels.
19.
The commission amount is subject to change if the order’s dollar amount changes after the order was shipped. Changes to the order amount would be handled through the Oliver’s Labels customer service team. Reasons may include:
19.1.
A full or partial refund due to a customer service issue.
19.2.
A partial refund due to applying a coupon code.
20.
A commission payment may be requested on the Commissions page or by contacting the Oliver’s Labels office by phone or email. Oliver’s Labels will use the information in the account profile to send the payment.
21.
An Administrator may choose to have the commission paid out in the form of a check (mailed) or Oliver’s Labels e-gift card (emailed).

Marketing

22.
The Referral Link and graphics provided by Oliver’s Labels may be shared on the Organization’s website(s), emails and social media such as Facebook, Twitter and blogs.
23.
The Referral Link may not be published or distributed on coupon sharing sites.
24.
The Referral Link and graphics provided by Oliver’s Labels may be used to advertise "offline" in classified ads, magazines, and newspapers.
25.
The Oliver’s Labels logo, marketing materials or photos may not be altered without expressed permission.
26.
Social media pages used for marketing the Referral Link must be labeled “_______ loves Oliver’s Labels” (example, “Happy Daycare loves Oliver’s Labels”) or “_______ fundraiser with Oliver’s Labels” (example, “Happy Daycare fundraiser with Oliver’s Labels”) in order to avoid confusion with the official Oliver’s Labels company pages.
27.
Customers may not be solicited from the Oliver’s Labels Facebook fan page, the comments section of the Oliver’s Labels blog or any other Oliver’s Labels social media outlet.
28.
An Administrator may use the e-blast tool on the Marketing Materials page to share the Referral Link to recipients known by the Organization or its members.

Code of Conduct

29.
A shopper who has placed an order with Oliver’s Labels either directly or through a referral is an Oliver’s Labels customer, not a customer or “client” of the Organization.
30.
An Administrator or Organization member may not represent themselves as an Oliver’s Labels employee, reseller or representative of the company.
31.
Oliver’s Labels orders must be placed directly from the customer:
31.1.
An Administrator, the Organization or its members may not collect an order from a customer and then place the order with Oliver’s Labels on behalf of the customer.
31.2.
An Administrator, the Organization or its members may not create a web page or website to sell Oliver’s Labels products.
31.3.
If the customer is unable to place the order on our website, Oliver’s Labels will facilitate the ordering process by phone.
31.4.
An Administrator, the Organization or its members, under no circumstances, may accept or request a payment for an Oliver’s Labels order. That includes money order, check, cash, e-transfer or any other form of payment.
32.
An Administrator, the Organization and its members must direct customers to contact Oliver’s Labels directly for all customer service inquiries and issues. This includes inquiries and issues referring to shipping times, order details and product performance.
33.
An Administrator, the Organization or its members may not participate in bulk email distribution, email distribution to strangers, or email distribution in any manner that would constitute or appear to constitute unsolicited commercial email or “spam.”
34.
An Administrator, the Organization and its members agree to comply with all laws as well those that govern email marketing and anti-spam laws.
