1.
Oliver’s Labels’ Agent program is now Oliver’s Labels’ Label League Referral Program (henceforth referred to as the “Referral Program” or “Program”).
2.
The term “Oliver’s Labels Agent” will no longer be used. Individuals that are registered in the Program will henceforth be referred to as “Members” or “Referrer.”
3.
The Referral Program allows members to earn commission on purchases from friends and family who use the Member’s custom referral website link, henceforth referred to as “Referral Link.”
4.
Oliver’s Labels reserves the right to cancel the Referral Program or to change or amend these Terms and Conditions at any time without notice.
5.
By participating in the Referral Program, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to participate in the Referral Program in any manner.
6.
You may not participate in the Referral Program where doing so would be prohibited by any applicable law, rule, or regulations.
7.
Oliver’s Labels reserves the right to suspend or terminate a Member without notice if the Member does not comply with any of these Terms and Conditions or at Oliver’s Labels discretion.
8.
Oliver’s Labels reserves the right to remove referred sales that are believed to be made in violation of these Terms and Conditions.
9.
Only with expressed consent by Oliver’s Labels can exceptions be made to the Terms and Conditions. For example, a Member outside of Canada or the United States.
10.
Employees of Oliver’s Labels and their immediate family members and household members may not participate in the Referral Program.
The Program
11.
There is no cost to register, join or maintain a Referral Program account.
12.
There is no purchase necessary to join the Referral Program.
13.
A Member has access to the Label League Zone in their account login area. Pages in the Label League Zone include Commissions, Marketing Materials, Program information, access to the Label League social media pages, and these Terms and Conditions.
14.
The format of the Referral Link is “www.oliverslabels.com/” plus a custom suffix requested by the Member. For example, “www.oliverslabels.com/janedoe”. The custom suffix may be rejected if the suffix is already being used or at Oliver’s Labels discretion, at which point another suffix may be requested.
15.
A Member receives credit for a sale when:
15.1.
The customer uses the Member’s Referral Link when making a purchase.
15.2.
The customer provides Oliver’s Labels with the name of the Member when making a purchase (online or by phone).
16.
When a Referral Link is used, a cookie is stored in the web browser associating the user with the Referrer. If the user returns to the Oliver’s Labels website up to a year later, the Referrer will continue to be associated with the user.
17.
When a Member is assigned a Referral Link, a matching custom coupon code (henceforth referred to as “Referral Coupon”) is automatically activated. The Referral Coupon code is the suffix of the Referral Link. For example, if the Referral Link is “www.oliverslabels.com/janedoe” then the Referral Coupon is “JANEDOE”.
18.
The Referral Coupon works only in conjunction with the matching Referral Link.
19.
The value of a Referral Coupon is 10% off sitewide, excluding gift cards, unless otherwise stated.
20.
A Member receives 15% commission (unless otherwise stated) on a referred orders’ subtotal, excluding gift cards and shipping and taxes and after coupons or discounts have been applied.
21.
A Member may refer organizations to sign up for an Oliver’s Labels Fundraiser.
22.
A Member receives credit for a Fundraiser when:
22.1.
The organization uses the Member’s Referral link when registering the Fundraiser.
22.2.
The organization provides Oliver’s Labels with the name of the Member when registering the Fundraiser.
23.
A Member receives 12% commission on the sales of a referred fundraiser (unless otherwise stated). This is based on the fundraiser collecting 20% and the Member collecting 15% of the remaining balance.
24.
A Member’s account has no performance expectations, quotas or requirements associated with sales in order to maintain the account.
25.
A Member’s account and account balance never expires.
26.
A Member may use their own Referral Link and Referral Coupon for personal orders.
Sales
27.
Commission for a sale appears on the Commissions page once the order status has been set to “shipped” by Oliver’s Labels.
28.
The commission amount is subject to change if the order’s dollar amount changes after the order was shipped. Changes to the order amount would be handled through the Oliver’s Labels customer service team. Reasons may include:
28.1.
A full or partial refund due to a customer service issue.
28.2.
A partial refund due to applying a coupon code.
29.
A commission payment may be requested on the Commissions page or by contacting the Oliver’s Labels office by phone or email. Oliver’s Labels will use the information in the Member’s account to send the payment.
29.1.
A first-time payment can be withdrawn when the commission balance reaches $60.
29.2.
After a first-time payment, subsequent payments may be withdrawn when the commission balance reaches $30.
29.3.
A Member may choose to have their commission paid out in the form of a check (mailed), PayPal (emailed), or Oliver’s Labels e-gift card (emailed).
Marketing
30.
All graphics used by a Member to market or share their Referral Link must be provided by Oliver’s Labels. A Member may not create his/her own marketing graphics.
31.
A Member may share their Referral Link and use graphics provided by Oliver’s Labels on personal or business websites, emails and social media such as Facebook, Twitter and blogs.
32.
A Member may not publish or distribute their Referral Link and Referral Coupon on coupon sharing sites.
33.
A Member may advertise "offline" in classified ads, magazines, and newspapers with graphics provided by Oliver’s Labels only.
34.
A Member may not alter the Oliver’s Labels logo, marketing materials or photos without expressed permission.
35.
Social media pages used for marketing your Referral Link must be named “_______ loves Oliver’s Labels” (example, “Jane loves Oliver’s Labels”) in order to avoid confusion with the official Oliver’s Labels company pages.
36.
A Member may not solicit customers from the Oliver’s Labels Facebook fan page, the comments section of the Oliver’s Labels blog or any other Oliver’s Labels social media outlet.
37.
A Member may use the e-blast tool on the Marketing Materials page to share his or her Referral Link to friends, family, colleagues and any other recipients known by the Member.
Code of Conduct
38.
A shopper who has placed an order with Oliver’s Labels either directly or as a result of a referral is an Oliver’s Labels customer, not a Member’s customer or “client”.
39.
A Member may not represent themselves as an Oliver’s Labels employee, reseller or representative of the company.
40.
Oliver’s Labels orders must be placed directly from the customer:
40.1.
A Member may not collect an order from a customer and then place the order with Oliver’s Labels on behalf of the customer.
40.2.
A Member may not create his or her own web page or website to sell Oliver’s Labels products.
40.3.
If the customer is unable to place the order on our website, Oliver’s Labels will facilitate the ordering process by phone.
40.4.
A Member under no circumstances may accept or request a payment for an Oliver’s Labels order. That includes money order, check, cash, e-transfer or any other form of payment.
41.
A Member may refer fundraisers but may not manage the fundraiser on behalf of the organization if he or she is not part of the organization.
42.
A Member may not be assigned to a fundraiser if the Member’s account was registered after the fundraiser account was registered.
43.
A Member must advise customers to contact Oliver’s Labels for all customer service inquiries and issues. This includes inquiries and issues referring to shipping times, order details and problems with product performance.
44.
A Member may not partake in bulk email distribution, email distribution to strangers, or email distribution in any manner that would constitute or appear to constitute unsolicited commercial email or “spam.”
45.
A Member agrees to comply with all laws including those that govern email marketing and anti-spam laws.
